Terms of Service

By using windriver.marketing or hiring Wind River Marketing for a project, you agree to these terms. If you don't agree, please don't use the site or engage our services.

Wind River Marketing is a student-run web and marketing shop based in Logan, Utah, operated by a Utah State University student, offering marketing websites, web apps and tools, local search setup, WordPress rescues, and ongoing site care.

Every engagement starts with a free first sitting, in person or by call. You'll leave that meeting with a written scope and a fixed price before any work begins — that scope, not this general page, governs the specific deliverables, timeline, and payment schedule for your project. Typical marketing-site timelines run three to six weeks from kickoff to launch.

Marketing-site pricing starts at $499 and is agreed in writing before work begins. Payment terms — deposit amount, schedule, and accepted methods — are set out in your project's written scope. Work on a project may pause if an agreed payment isn't received on schedule.

Changes beyond what's described in your written scope — new pages, extra rounds of revisions, added functionality — may increase the price or timeline. We'll always discuss and agree to changes in writing before doing the extra work.

Once your project is paid in full, you own the content, design, and custom code built specifically for your site. Any third-party platforms, fonts, stock images, plugins, or open-source libraries used in the build remain subject to their own licenses.

We may display your finished site in our own portfolio and marketing materials unless you ask us in writing not to.

Sites are typically hosted on Netlify. Unless you're on one of our care plans, you're responsible for your own hosting and domain costs and renewals going forward. Our care plan is billed monthly, includes updates, small changes, and backups, carries no long-term contract, and can be canceled at any time.

We build sites and tools to a high standard, but we can't guarantee specific business outcomes — like search rankings, traffic, leads, or sales — since those depend on many factors outside our control.

The website and any tools we build are provided as-is. We'll fix bugs we introduce and stand behind our work, but we don't promise the site will be error-free or available without interruption at all times — for example, during a hosting outage outside our control.

To the extent allowed by law, Wind River Marketing's total liability for any claim related to our services is limited to the amount you paid us for the specific project giving rise to the claim. We aren't liable for indirect or consequential damages, like lost profits.

Either of us can end a project engagement by giving written notice. You'll owe payment for work completed up to that point, and we'll deliver what's been finished and paid for.

These terms are governed by the laws of the State of Utah, without regard to conflict-of-law rules.

We may update these terms from time to time; the date below shows the last revision. Continuing to use our services after an update means you accept the revised terms.
